Welcome to the Revibed platform. These Terms of Use outline the terms and conditions governing your use of the Revibed platform.
By accessing or using the Revibed platform, you agree to comply with these Terms.

We are Revibed, which is a trade name of NEW WAVE B.V., a company under Belgian law, with registered office at Kernenergiestraat 19 (b. R9), 2610 Wilrijk, Belgium and with company number 0805.914.503, VAT number BE0805914503 (hereinafter referred to as “We”, “Us”, “Our”).

Acceptance of the Terms
By accessing or using the Revibed platform (the “Platform”), you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as any additional guidelines, rules, and policies posted on the Platform. These Terms of Use are applicable to all offers, services and functionalities on the Platform.
When creating an account on the Platform, We will ask you to confirm your express acceptance of Our Terms of Use and the Privacy Policy by ticking the corresponding box. This confirmation is necessary for you to participate on Our Platform. This acceptance can only be full and complete. Any conditional acceptance is considered invalid. Users who do not agree to be bound by the Terms of Use cannot use the Platform and the functionalities that it provides.
Minimum Age Requirement
You must be at least 16 years of age to use the Platform without parental consent. If you are between 13 and 16 years of age, you may access and/or use the Platform only if you have obtained prior consent from your parents or legal guardian. You will be asked to declare the age range to which you belong when setting up an account. If you are between 13 and 16 years of age, you will be asked to confirm that you have obtained the prior consent of your parents or guardian.
It is important to note that while using the Platform, you may encounter music content that contains social and cultural language and ideas that may not be suitable for all audiences, particularly children. We advise parents and legal guardians to exercise caution when allowing children to access or engage with the Platform's content. We encourage responsible use and recommend reviewing and assessing the appropriateness of the content before allowing children to listen to or interact with it. At Revibed, We are committed to maintaining a diverse range of music, but we also prioritize the safety and well-being of all users, especially younger audiences.
Description of Service
Revibed serves as an intermediary in facilitating the purchase, digitization and resale of rare recordings on CD, vinyl, or cassette.
We expressly reserve the right to modify, suspend or discontinue any aspect of the Platform at any time without notice.
Payments and Account Balance
Each account on the Revibed platform is provided with an internal account denominated in euros. Users can top up their internal account balance with specific amounts, including 10, 25, 50 or 100 euros, through payment methods facilitated by Paypal or Stripe.
Users can only purchase goods, including albums, individual music tracks, or pre-order items, utilizing the funds available in their internal account. When making a purchase, users can add selected goods to their cart and complete the transaction by paying for the entire order using their internal account balance.
Pre-Orders
Users may also choose to pay for pre-orders. Funds allocated for pre-orders are held in a designated pre-order account until the corresponding digital copy becomes available for download. Upon the release of the digital copy, users who have paid for the pre-order will gain access to download the album. The pre-order transaction is considered complete upon the release of the digital copy.
If a pre-order fails to reach the required number of contributions or if it becomes unfeasible to create a digital copy, the full amount will be refunded to the users' internal accounts.
In cases where a recording fails to reach the required number of contributions, Revibed reserves the right to contribute the additional funds necessary to proceed with digitization. This action may be taken when Revibed deems the digitization of a recording essential in the light of preservation of musical heritage.
Withdrawal of Funds
Users are, at any time, entitled to a withdrawal request of the funds present in their internal account. You can make a withdrawal request in your account settings. Please keep in mind that a withdrawal fee of 2% of the requested withdrawal amount will be deducted. The remaining balance will then be transferred to your Paypal account.Appropriate use of the digitalized recordings
The downloaded digitalized recording of a rare musical work made available by Us can only be used for personal enjoyment and cannot, under any circumstances, be sold or commercialized. Sharing or distributing any of this copyrighted material without appropriate authorization is strictly prohibited.
It is prohibited to use the Platform to promote or facilitate the sale of unauthorized reproductions of copyrighted works. The mission of the Platform is rooted in respect for the authors/composers and artists who created and interpreted these musical masterpieces, on the one hand, and rights of music publishers and master owners who invested therein, on the other. We kindly ask you to use the Platform with this in mind.
Intellectual property
Our website, logos, texts, photos, names, and communications are protected by intellectual property rights that either belong to Us, Our suppliers or other right holders.
It is strictly prohibited to use and/or make changes to the intellectual property rights described in this article. For example, you may not copy or reproduce drawings, photographs names, texts, logos color combination, etc. without Our prior, express, and written consent.
Prohibited Behavior
Users of the Platform are required to adhere to ethical and lawful standards while utilizing the services provided. The following actions are strictly prohibited and may result in immediate suspension or termination of your account, as well as legal action where applicable:
- any fraudulent, misleading, or deceptive activities, including but not limited to, providing false or misleading information, impersonating another individual, organization or entity and attempting to gain unauthorized access to other users' accounts;
- any form of harassment, hate speech, offensive behavior or posting content that is discriminatory, derogatory or promotes violence;
- any illegal activities, including facilitating the sale of prohibited or illegal items and engaging in money laundering or other financial crimes;
- any attempt to hack, disrupt, circumvent, or compromise the security of the Platform or its users' data;
- any activities that disrupt or harm the functionality of the Platform or its users' experience;
- advertising or promoting products or services unrelated to the Platform's purpose;
- any activities that are in violation of the Terms of Use.
Limitation of Liability
We provide the Platform "as is" and do not make any warranties regarding the accuracy, completeness, or reliability of the information or materials available on the Platform.
The Platform may contain user-generated content, links to third-party websites, and other materials. We do not endorse, verify or guarantee the accuracy or legality of such content.
We shall not be liable for any failure or delay in performance caused by events beyond Our control, including but not limited to acts of nature and technical failures.
We do not endorse, control or assume any responsibility for the actions, content or conduct of users on the Platform. Any interactions or transactions between users are solely their responsibility.
We shall not be liable for any resulting loss or inconvenience due to Our right to modify or discontinue any part of the Platform without notice.
The maximum liability for any claims, damages, losses or disputes arising from your use of Our services is limited to the extent permitted by the applicable laws. In no event shall Our liability exceed the total fees you've paid to Us for the specific use of the service for which claims are made. By using the Platform, you acknowledge and accept these limitations of Our liability.
Applicable law and jurisdiction
These Terms of Use are governed by Belgian law. All agreements that We conclude with Our users, regardless of their place of residence, are governed exclusively by Belgian law and, in the event of a dispute, only the Dutch speaking courts of Brussels are competent. If, for reasons of international law, another law is applicable, the interpretation of these Terms of Use will be based on Belgian Law.
